Terms Of Use

The following are the terms and conditions between The Creator and The Subscriber for the use of any and all Courses to which access has been purchased.

The Subscriber:You

The Creator:Jordan Kelly

Subscription Period:12 months from the date of hand-over of the Subscriber’s password-protected Course access portal.

Course Materials:All materials provided by the Creator for the Course. Course Materials may comprise any of the following: Digital resources (Digital Rights Protected .pdf format training manuals and other written materials), videos, audios, and any other learning resources added to a Customer’s Portal, from time to time, at the discretion of the Creator.

The Subscriber acknowledges and agrees that access to the Course Materials is provided to the Subscriber’s appointed Instructor and Students only in accordance with the terms and conditions of this Agreement.

Use of Course Materials

Course Materials by the Creator are supplied in a digital environment, unless otherwise stated in the product description on the website from which access was purchased. These are available for viewing online and may not be downloaded.

  1. The Course Materials, including copyright and all other such intellectual property rights contained therein, are the property of the Creator.
  2. For the Subscription Period, the Creator grants the Subscriber access to use the Course Materials. All Course Materials are provided to the Subscriber solely for the purposes of the completion of the Course by the Subscriber’s 16 appointed personnel (i.e. one Instructor and 15 Students).
  3. The Subscriber may not reproduce any part of the Course Materials without the prior written consent of the Creator. The Subscriber shall not use any of the materials in any manner, or for any purpose other than as expressly permitted by this Agreement. It is strictly prohibited to transmit, reproduce, sell or distribute any of the Course Materials in any form or by any means, including but not limited to photocopying, recording, screen capturing, copying down, or other electronic or mechanical methods.
  4. The Subscriber shall not record or replicate parts of the Course, whether in .pdf, audio, video or other formats, without the written permission of the Creator.
  5. The Subscriber shall not sell, re-sell or reproduce, or cause or permit any other parties to sell, re-sell or reproduce, any of the Course Materials.
  6. The Subscriber shall not use the Course Materials to deliver any training other than to its own appointed in-house personnel, being the 16 appointees (Instructor and 15 Students) for which access has been paid for by the subscription fee.
  7. If the Subscriber, its Instructor, or any of the Students breach this Agreement, then the Creator may:
    • Advise the Subscriber in writing of the perceived breach.
    • In its discretion, cancel the Subscriber’s access to the Course Materials, without refund, if the Subscriber fails to respond or fails to provide a satisfactory explanation.
    • Take appropriate legal action to remedy the breach.

Course Subscription Fees

The Course Fees provide the Subscriber with an annual subscription for access to the specified number of Digital Rights Protected .pdf format training manuals pertaining to the Course, along with any other Course Material that the Creator may, in its discretion, provide or add at any time during the period of the subscription.

The subscription provides 16 access points (i.e. one instructor and 15 Students), with the Course portal set up and activated by the Creator’s Administrator within five working days following provision of basic information by the Subscriber to allow access rights customisation.

All Course Fees are non-refundable, non-transferable and expire after 12 months.

Subscription pricing for larger numbers of trainees, and/or the production of a bespoke version of your desired course, can be negotiated.

Course Content

No warranty is made by the Creator regarding any information, services or products provided through, or in connection with this website, unless expressly agreed.

The Creator hereby expressly disclaims any and all warranties, including without limitation: any warranties as to the availability, accuracy or content of information, products or services, and any warranties of merchantability or fitness for a particular purpose.

The Creator shall not be liable for damages of any kind resulting from the use of any content within the website itself, nor of the Course Materials.

Communications

The Subscriber agrees to receive email communication, announcements and/or updates pertaining to the Course, other relevant courses and/or other Jordan Kelly educational offerings.The Subscriber agrees to provide current contact point/s and email address/addresses for the instructor and course to facilitate communication.

The Creator may send email communication until 24 months after completion of the Course.

The Subscriber, its Instructor or Students may opt out of receiving email communication from the Creator by using the Unsubscribe button.

Confidentiality and Privacy Policy

The Creator shall make reasonable efforts to keep any such information that it collects from the Subscriber, its Instructor and Students secure, and to ensure that any of its employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction, or disclosure of that information.

The Creator will only disclose information that we have received from the Subscriber:

  • to the extent required by law; or
  • for the purposes of this agreement.

Collected Information

The Creator tracks the following information:

User Name and Password

An administrative user will be assigned a User Name and an initial password that can be changed at any time. The User Name is used for security purposes and to manage content provisioning.

Email Address

End-users (i.e.Students) will be requested to enter an email address to view content that has been shared with them. The email address is used for security purposes and to manage content provisioning.

IP Address

Your IP address is a number that is automatically assigned, by your Internet Service Provider, to the computer that you are using. An IP address may be logged automatically in our server log files whenever you access our services, along with the time of the visit and the pages visited.

Collecting IP addresses is done automatically by many websites, applications, and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems, and administering our services.

We may also derive your approximate location from your IP address.

Device ID

A unique device ID is assigned to your browser using a cookie. This ID can be used to limit your access via a Digital Rights Management (DRM) setting defined by the Creator i.e. the content provider.

Browser and OS Meta Data

In addition, for analytical purposes and troubleshooting, we attempt to collect the type and version of browser in use; the language that the browser is set to use; and the type and version of Operating System (OS).
